1. Acceptance of Terms

By accessing or using the website, services, or any tools provided by AutoAnonymous LLC ("AutoAnonymous," "we," "us," or "our"), you agree to be bound by these Terms of Use ("Terms"), as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms or the Privacy Policy, you are not authorized to use our Services and must discontinue use immediately.

2. Eligibility and Compliance

You affirm that you are at least 18 years of age or the age of legal majority in your jurisdiction (whichever is higher). If you are under the age of majority in your region (but at least 13), you may use the Services only with the involvement and supervision of a parent or legal guardian. We prohibit use by anyone under the age of 13. If we are notified or become aware of such unauthorized use, we reserve the right to delete related information immediately.

3. Permitted Uses and Prohibited Conduct

Permitted Uses:

  • Engage with online content, tools, and professional resources provided by AutoAnonymous;
  • Create user accounts or profiles for the purpose of using our Services;
  • Communicate with our support team, professionals, or peers through official channels. 

Prohibited Conduct:
You agree not to: 

  • Violate applicable laws or infringe third-party rights;
  • Access or use our Services if your account is suspended or terminated;
  • Post defamatory, harassing, or discriminatory content;
  • Distribute spam, malware, or harmful code;
  • Harvest, scrape, or collect information about other users without consent;
  • Impersonate individuals or misrepresent affiliations;
  • Circumvent or interfere with platform security measures;
  • Post or share any content that breaches any employment contract, non-disclosure agreement (NDA), confidentiality obligation, or proprietary duty you owe to any third party, including employers, dealers, manufacturers, or other business entities.

    These prohibitions draw from standard community usage guidelines.

3.1 User Content Representations and Warranties

By posting, uploading, or sharing any content on the Services ("User Content"), you represent and warrant that:

  • You own all rights to the User Content or have obtained all necessary permissions, licenses, and consents to post it;
  • Your User Content does not and will not infringe upon any copyright, trademark, patent, trade secret, or other intellectual property or proprietary right of any third party;
  • Your User Content does not breach any employment contract, non-disclosure agreement, confidentiality obligation, or fiduciary duty you owe to any employer, client, or other third party;
  • Your User Content does not contain defamatory, harassing, discriminatory, threatening, or otherwise unlawful material;
  • You have the legal right and authority to post the User Content without violating any applicable laws or agreements.
     

3.2 Content Moderation Rights

AutoAnonymous reserves the right (but not the obligation) to review, monitor, refuse, edit, or remove any User Content at its sole discretion, for any reason or no reason, at any time, without prior notice or liability to you. We are under no obligation to monitor, screen, or moderate User Content, but we retain full discretion to do so to enforce these Terms, comply with legal requirements, or protect our interests and those of our users.

4. Account Responsibility

When registering for an account, you agree to provide accurate and complete information and to update it promptly if changes occur. You are responsible for safeguarding your login credentials and all activity under your account. Notify us immediately of any unauthorized access or breach.

5. Intellectual Property Rights

All content, features, data, and intellectual property made available through the Services ("Content") are owned or licensed by AutoAnonymous and protected under copyright, trademark, and other laws. Your access does not grant ownership or rights to reproduce, distribute, modify, or otherwise use the Content outside the intended scope of our Services. Unauthorized use may result in legal action.

6. Risks, Disclaimers, and Limitation of Liability

6.1 General Disclaimer

The Services are provided on an "as is" and "as available" basis, with no express or implied warranties, including fitness for a particular purpose or non-infringement. To the fullest extent permitted by law, AutoAnonymous disclaims all liability for damages related to your use of the Services, including indirect, incidental, or consequential losses. Where disclaimers are restricted by law, our liability is limited to the minimum permitted.

6.2 Specific Risk Acknowledgment

You acknowledge and agree that use of the Services involves inherent risks, including but not limited to: data loss, unauthorized access to accounts, system outages or interruptions, errors or inaccuracies in content, and potential security breaches. AutoAnonymous is not liable for any such occurrences or their consequences.

6.3 Third-Party Content Disclaimer

AutoAnonymous does not endorse, verify, or assume responsibility for any User Content or third-party content posted on the Services. Views expressed by users do not reflect the views of AutoAnonymous.

6.4 No Liability for User Actions

AutoAnonymous is not responsible for the conduct of any user, whether online or offline, or for any content posted by users. You are solely responsible for your interactions with other users.

6.5 Interactive Computer Service Provider Status

AutoAnonymous is an interactive computer service provider within the meaning of Section 230 of the Communications Decency Act, 47 U.S.C. § 230. AutoAnonymous is not the publisher or speaker of any User Content posted by third parties on the Services. To the fullest extent permitted by law, AutoAnonymous shall not be held liable for any User Content provided by third-party users, including but not limited to claims of defamation, libel, slander, or other tortious conduct arising from such content.

6.6 DMCA Compliance and Copyright Policy

AutoAnonymous respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we have implemented procedures for receiving written notification of claimed copyright infringement and for processing such claims.

Filing a DMCA Notice:

If you believe that your copyrighted work has been copied and posted on the Services in a way that constitutes copyright infringement, please provide our designated DMCA Agent with the following information in writing:

  • Your physical or electronic signature;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the allegedly infringing material and information reasonably sufficient to permit us to locate it (e.g., URL);
  • Your contact information (address, telephone number, and email address);
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Counter-Notice:

If you believe your content was wrongly removed due to a DMCA notice, you may file a counter-notice containing the information specified in the DMCA. Upon receipt of a valid counter-notice, we may restore the removed content in accordance with DMCA procedures.

Repeat Infringer Policy:

AutoAnonymous will terminate the accounts of users who are repeat infringers of copyright in appropriate circumstances.

6.7 User Indemnification

You agree to indemnify, defend, and hold harmless AutoAnonymous LLC, its officers, directors, employees, agents, affiliates, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Services;
  • Your User Content or any content you post, upload, or share;
  • Your violation of these Terms;
  • Your violation of any rights of another person or entity, including but not limited to intellectual property rights, privacy rights, or contractual rights;
  • Any claims of copyright infringement, trademark infringement, defamation, breach of confidentiality, or other tortious conduct arising from your User Content or actions;
  • Your breach of any employment agreement, non-disclosure agreement, or other confidentiality obligation.

This indemnification obligation will survive termination of these Terms and your use of the Services.

7. Link to Privacy Policy

We value transparency. Information about how we collect, use, protect, and retain your data can be found in our Privacy Policy, which complements these Terms. Please review it carefully before proceeding with use.

8. Modifications to Terms

AutoAnonymous reserves the right to modify these Terms at its discretion. Material changes will be communicated by updating the effective date and posting the revised Terms on our website. Continued use of the Services following such updates constitutes acceptance of the new Terms.

9. Termination and Enforcement

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we believe your actions may create legal risk or harm. Enforcement measures may include content removal, account termination, or legal action as appropriate to the situation.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

10.2 Venue

Any disputes that are not subject to arbitration as described below shall be resolved in the state or federal courts located in Wyoming, with both parties submitting to the jurisdiction of such courts.

10.3 Mandatory Arbitration

Any controversy, dispute, or claim arising out of or relating to these Terms, the Services, or your relationship with AutoAnonymous (collectively, "Disputes") shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

10.4 Arbitration Procedures

The arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Wyoming, or at another mutually agreed location. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court having jurisdiction.

10.5 Class Action Waiver

You and AutoAnonymous agree that each party may bring Disputes against the other party only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative action or proceeding. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not permitted. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

10.6 Confidentiality

All aspects of the arbitration proceeding, including the award of the arbitrator and compliance therewith, shall be strictly confidential, except as may be necessary to enforce the award or as required by law.

10.7 Opt-Out Right

You have the right to opt out of this arbitration provision by sending written notice of your decision to opt out to Hello@autoanonymous.com within 30 days of first accepting these Terms. If you opt out, all other terms of these Terms will continue to apply.
